License

Your use of the Notixy app distributed on the App Store is governed by Apple’s Standard End User License Agreement (EULA), which applies automatically because Notixy does not provide a custom EULA of its own. This page is a short supplement covering a few practical points; where anything here conflicts with Apple’s EULA, the EULA governs.

What the service does

Notixy relays notifications from third-party senders — businesses and individuals — to the users who subscribed to them. It is free for users. See the Privacy Policy for what is processed and how long notifications are kept.

Eligibility

You represent that you are of legal age to enter into these Terms in your jurisdiction and that your use of the app is lawful where you are located.

You stay in control

A sender can notify you only after you subscribe, and only in the categories you allowed. You can subscribe from the catalog, by scanning a sender’s QR code, or by answering a sender’s request after it scans the QR code you show; in each case you choose what to allow. You can unsubscribe, pause a sender for a limited time, or report a sender or a message at any time, from the app. You can set quiet hours and a daily limit, and decide whether a sender sees your nickname (unless that sender requires nicknames, which the app tells you before you subscribe).

Senders are responsible for their content

The content of a notification is written or parameterised by the sender, not by Notixy. Senders are solely responsible for what they send and for having the right to send it. Notixy does not endorse any sender or any message.

What senders must not send

Senders must not use Notixy for:

• spam or unsolicited messages;
• phishing, fraud, or attempts to obtain credentials or personal data by deception;
• impersonating another person, business or brand;
• illegal content, or content that is abusive, harassing or hateful;
• marketing in a category meant for something else — in particular, using the time-sensitive or critical-alert category to deliver promotions.

Reports and suspension

Reports from users are reviewed. We may remove content, restrict a sender’s categories, or suspend or remove a sender at any time, with or without notice, if we believe these Terms or the rules for senders have been broken.

Time-sensitive messages

Time-sensitive messages are short-lived and notification delivery cannot be guaranteed, so a service must not rely on Notixy for anything where a delayed or missed message would cause harm.

Delivery

Delivery of a notification depends on Apple’s Push Notification service, your device settings and network conditions, none of which we control. We do not guarantee that any notification will be delivered, delivered on time, or delivered at all. The app also loads your recent notifications when you open it. The experimental “Route via proxy” setting is offered as is and may change or stop working at any time.

Third-party services

Notixy relies on third-party services, including Apple’s Push Notification service and hosting providers. They are independent of the developer, who is not responsible for their availability or continued existence.

No warranty

Notixy is provided “as is” and “as available,” without warranty of any kind, express or implied, to the maximum extent permitted by law, including but not limited to warranties of merchantability, fitness for a particular purpose, or availability. We do not warrant that the service will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall the developer be liable for any claim, loss, or damages of any kind — direct, indirect, incidental, or consequential — including but not limited to missed, delayed or incorrect notifications, or the content of messages sent by senders, arising from or in connection with the app or your use of it. This applies whether the claim is based in contract, tort, or any other legal theory. Nothing in this section is intended to exclude any liability that cannot lawfully be excluded; where a jurisdiction does not permit certain exclusions, this section applies to the maximum extent that jurisdiction allows.

Termination

You may stop using Notixy at any time. To remove the data we hold about you, use Delete my data in the app’s Settings before uninstalling; see the Privacy Policy.

Changes to these terms

If these terms change, the update is posted here with a new “Last updated” date above. Continued use of the app after a change constitutes your acceptance of the revised Terms.
