License

Your use of the Deep Happy app, once distributed on the Mac App Store, is governed by Apple's Standard End User License Agreement (EULA), which applies automatically because Deep Happy does not provide a custom EULA of its own. This page is a short supplement covering a few practical points; where anything here conflicts with Apple's EULA, the EULA governs.

Deep Happy is a player, not a broadcaster

Deep Happy does not provide, host, own, curate, license or control any audio. It is a player: it opens the address of a stream held in the station list on your Mac, and plays whatever that server sends back. The stream you hear is the one you selected, at an address you can see, edit and remove.

Every stream is operated by an independent third party. What it broadcasts, whether it broadcasts at all, and the terms on which it may be received are that operator's business, not the developer's. No audio passes through any server belonging to this app or this site.

Deep Happy is not affiliated with, endorsed by, sponsored by or otherwise connected to any radio station, broadcaster, station directory, or music service. Where a third party's name appears — in the app or on this site — it is there for identification only, to say which service a link, a search or a stream address belongs to. All trademarks and content are the property of their respective owners.

You are responsible for the streams you add and play: for having the right to access them where that right is not open to everyone, and for observing whatever terms their operator sets. The developer does not vet, approve or endorse stream addresses, and cannot tell you whether a particular stream may be received in your country.

If you operate a stream or hold rights in content and believe Deep Happy is being used in a way that infringes them, the feedback form reaches the developer directly and is the right place to say so.

Third-party services the app connects you to

"Find a station…" searches radio-browser.info, an open station directory run independently of this app, with its own terms and its own privacy practices. The developer does not operate it, has no relationship with it, and does not stand behind what it returns: the results, and the accuracy of the addresses in them, are the directory's.

The Spotify, Apple Music and Yandex Music buttons hand a search URL to your default browser. The app is not affiliated with any of those services, sends them nothing itself, and once the browser opens, that service's own terms and privacy policy apply to what happens there.

What you're licensed to do

Apple's Standard EULA licenses you to use Deep Happy on devices signed into your Apple ID, on Apple's licensing terms. None of this transfers any ownership of the app or its source code. It grants you no rights in any stream, station name, artwork or recording reached through the app — those belong to whoever owns them, and nothing here changes that.

Your station list, your preferences and your Macs are yours. The developer never sees them.

Subscription

Deep Happy Pro is an auto-renewable subscription, and starting playback requires it. It is sold by Apple through the Mac App Store; the developer never sees your payment details.

The plans are Weekly, $1.99 per week; Monthly, $4.99 per month; and Yearly, $49.99 per year. Those are the prices in the United States storefront — the price in your own storefront comes from Apple's price matrix and is always shown in the app before you buy.

The monthly and the yearly plan each open with a 14-day free trial for new subscribers. One trial is available per subscription group, so it cannot be taken twice by switching between plans. Any unused part of a free trial is forfeited when a subscription is bought.

Payment is charged to your Apple ID at confirmation of purchase. A subscription renews automatically at the end of each period unless auto-renewal is switched off at least 24 hours before the end of that period, and the renewal is charged within 24 hours of it.

Managing and cancelling happen in your Apple ID account settings, not on this site and not inside the app — the app's "Manage subscription" link opens Apple's own page for it. Deleting the app does not cancel the subscription.

Refunds are Apple's to give; requests go through Apple's own process and the developer cannot issue one.

A lapsed subscription never interrupts audio that is already playing, and never takes away Stop, mute or the volume control.

Availability

Internet radio stations come and go, change their addresses, and go offline without warning, and the directory the app searches is a service somebody else runs. Nothing here promises that any particular stream, station or search will be reachable, now or later. The app's job is to tell you truthfully what is happening when one is not.

No warranty

Deep Happy is provided "as is," without warranty of any kind, express or implied, to the maximum extent permitted by law. It is not guaranteed to be error-free or uninterrupted, and you use it at your own risk.

Limitation of liability

To the maximum extent permitted by law, the developer is not liable for any indirect, incidental, special or consequential loss arising from your use of Deep Happy — including anything reached through a third-party stream, directory or service, or lost profits or time. Where liability cannot be excluded, it is limited to the amount you actually paid for Deep Happy in the twelve months before the claim.

Nothing here limits any right you have under consumer law that cannot be waived, and in some jurisdictions the exclusions above do not apply in full.

Termination

You can stop using Deep Happy at any time by deleting the app. There is no account to close, but deleting the app does not cancel a Deep Happy Pro subscription — that is cancelled in your Apple ID account settings, as the Subscription section above describes. These terms end when you stop using the app; the "no warranty" and "limitation of liability" sections above survive that ending.
